General Terms and Conditions

 

  • General order and delivery conditions for offers and services from Rainer Tschernay, Painter & Graphic artist (RATSCH | Rainer Tschernay | ratsch.eu) – hereinafter referred to as RATSCH; Status: 10.2021

    • 1. Scope

      • 1.1. The following conditions apply exclusively to the delivery or rendering of offers or services that you can order or book online from RATSCH. This also applies in particular if you use general terms and conditions (GTC) and these contain conditions that conflict with or deviate from the conditions listed here.

      • 1.2. The conditions listed here also apply if RATSCH carries out the order from you without reservation while being aware of conditions that contradict or deviate from the conditions listed here.

      • 1.3. Deviations from the conditions listed here are only valid if RATSCH expressly agrees to them in writing.

      • 1.4. Litigation will take place in Berlin (Germany).

    • 2. Ordering and booking of offers and services

      • 2.1. Descriptive links refer to offers and services that can be ordered and booked. In addition to the price and general information, special descriptions are also given there. Unless a price is specified, it is an inquiry that must be agreed individually. Offers and services are non-binding.

      • 2.2. You order or book online on the basis of the website. An order or booking is only possible if you are over 18 years of age. By clicking the “Submit order” or “Submit booking” button, your order or booking data and your personal data will be sent to us. Your order or booking is therefore legally binding and you will receive an order number.

      • 2.3. Your order or booking is effective when an email is sent containing the data of your order as a contract.

    • 3. Delivery and provision

      • 3.1. Unless otherwise agreed, delivery will be made to the delivery address specified by the customer. Delivery is only made to addresses within Germany.

      • 3.2. Unless otherwise agreed, the service will be provided at the venue specified by the provider. The customer bears the costs of traveling to the event location, accommodation and meals for himself.

      • 3.3. Insofar as information about the delivery period is given, it is non-binding, unless the delivery date has been promised as an exception.

    • 4. Payment

      • 4.1. Payment is made by bank transfer to the account specified in the course of the order or booking.

      • 4.2. The transfer amount must be posted to the recipient’s account within the payment period specified in the order.

    • 5. Offsetting and retention

      • 5.1. The customer is only entitled to offset if his counterclaims have been legally established or have been recognized by RATSCH in writing.

      • 5.2. You are only entitled to withhold payment if the counterclaims are based on the same contractual relationship.

    • 6. Retention of title

      • 6.1. The ordered and booked offers and services remain the property of RATSCH until they have been paid for in full.

    • 7. Warranty

      • 7.1. The statutory provisions for liability for material defects apply. Please submit your claims directly to Dipl.-Ing. Rainer Tschernay, Painter & Graphic artist, Neumannstrasse 135, 13189 Berlin, applies.

    • 8. Data protection

      • 8.1. The customer agrees that his personal data will be stored in machine-readable form and processed or used for the purpose of executing the existing contractual relationship. The data is used in particular for invoicing, delivery and provision of the order and booking item. The data will not be passed on to third parties for purposes other than the execution of the contract.

      • 8.2. The customer declares that he agrees that his data may be used to inform him about new offers or services for which, as evidenced by the order or booking made, a particular interest can be assumed.

      • 8.3. The customer is free at any time, free of charge, to query all of the personal data that has been collected. He has the right to object to any further use of his data. The objection can be made in writing or electronically. After all outstanding order or booking processes have been completed, all data, with the exception of the entries required for billing purposes, will be deleted immediately.

    • Right of withdrawal

You can revoke your contract declaration within two weeks without giving reasons in writing (e.g. email, letter, fax) or by returning the item. The period only begins with receipt of this instruction and receipt of the item by you. Timely dispatch of the cancellation or the item is sufficient to meet the cancellation deadline.     • Consequences of cancellation

In the case of an effective revocation, mutually received services may have to be returned and any benefits drawn may have to be surrendered. If you cannot return any offers and / or services you have received in whole or in part, or only in a deteriorated condition, you may have to pay compensation in this respect. This does not apply to the surrender of items if the deterioration of the item is solely due to its inspection – as it would have been possible for you in a shop, for example.

Incidentally, you can avoid the obligation to pay compensation by not using the item like an owner and by refraining from anything that may impair its value. In the case of a return from a delivery of goods for which the price of the goods to be returned does not exceed EUR 40.00, you have to bear the costs of the return if the goods delivered correspond to the goods ordered. Otherwise, the return is free for you.

The right of withdrawal does not apply to goods that have been manufactured according to customer specifications or that are clearly tailored to the personal needs of the customer or that are not suitable for return due to their nature. Furthermore, a right of withdrawal is excluded for the delivery of audio, video recordings and software if the delivered data carriers have been unsealed by the customer, as well as for the delivery of newspapers, magazines and magazines.

    • 1. Scope

      • 1.1. The following conditions apply exclusively to registration for consultations and seminars for which you can register online with RATSCH on the Internet. This also applies in particular if you use general terms and conditions (GTC) and these contain conditions that conflict with or deviate from the conditions listed here.

      • 1.2. The conditions listed here also apply if RATSCH carries out the order from you without reservation while being aware of conditions that contradict or deviate from the conditions listed here.

      • 1.3. Deviations from the conditions listed here are only valid if RATSCH expressly agrees to them in writing.

      • 1.4. Litigation will take place in Berlin (Germany).

    • 2. Registration for consultations and seminars

      • 2.1. Descriptive links refer to verifiable consultations and seminars. In addition to the price and general information, special descriptions are also given there. The price does not include costs for your journey to the venue, for accommodation and meals. Consultations and seminars are non-binding.

      • 2.2. Up to four weeks before the consultation date or the start of the seminar, you will not incur a cancellation fee if you cancel. The cancellation fee is 50% up to two weeks before the consultation or the start of the seminar and then 100% of the stated price of the consultation or seminar. You are welcome to have someone named by you represent you at no additional cost.

      • 2.3. You register online on the basis of the website. Registration is only possible if you have already reached the age of 18. By clicking the “Submit registration” button, your registration data and your personal data will be sent to us. Your registration is legally binding and you will receive an order number. Please note that in order to book a consultation or a seminar, your personal registration is required and you can therefore only register once per event.

      • 2.4. Consultations and seminars have a specified limit on the number of participants. Your registration will be considered in the order in which it is received. Your registration will be confirmed and will only then be effective when an email is sent containing the data of your registration as a contract. If the minimum number of participants for consultations or seminars is not reached or if other reasons make it impossible to hold the consultation or the seminar, RATSCH reserves the right to cancel the consultation or seminar in writing up to 14 days before the date of the event without RATSCH incurring any financial claims to be entitled to.

    • 3. Payment

      • 3.1 For individuals and groups of people, payment against an invoice is made in cash before the start of the consultation or seminar, as an exception, however, at the latest immediately after the end of the consultation or seminar.

      • 3.2. For organizations, associations, foundations, societies, institutions, companies, etc., payment is made by bank transfer to the account specified during registration so that the transfer amount is posted to the recipient’s account within the payment deadline no later than the 6th day after the end of the consultation or seminar have to be.

    • 4. Offsetting and retention

      • 4.1. The customer is only entitled to offset if his counterclaims have been legally established or have been recognized by RATSCH in writing.

      • 4.2. You are only entitled to withhold payment if the counterclaims are based on the same contractual relationship.

The data is used in particular for billing, implementation and provision of consultations and seminars. The data will not be passed on to third parties for purposes other than the execution of the contract.

      • 5.2. The applicant declares that he/she agrees that his/her data may be used in order to inform him about new consultations or seminars in which, as evidenced by the registration, a particular interest can be assumed.

      • 5.3. The applicant is free at any time and free of charge to query all of the personal data that has been collected. He has the right to object to any further use of his data. The objection can be made in writing or electronically. After all outstanding registration processes have been completed, all data, with the exception of the entries required for billing purposes, will be deleted immediately.

    • Right of withdrawal

You can revoke your contract declaration up to two weeks before the start of the event without giving reasons, but with a cancellation fee of 50%, in text form (e.g. email, letter, fax). Revoke your contract declaration less than two weeks before the start of the event in writing (e.g. email, letter, fax) – reasons for this do not have to be given, a cancellation fee of 100% applies. The period only begins with receipt of this instruction. Timely dispatch of the cancellation is sufficient to meet the cancellation deadline. The revocation must be sent to:
